Acceptable Use Policy #

1. Overview #

This Acceptable Use Policy ("AUP") governs your use of the Capysaurus capacity management platform and related services (the "Service") provided by Capysaurus LLC ("Capysaurus," "we," "us," or "our"). This AUP is incorporated into and forms part of our Terms of Service.

By using the Service, you agree to comply with this AUP. Violation of this AUP may result in suspension or termination of your account.

2. Intended Use #

2.1 Permitted Uses #

The Service is designed and intended for:

  • Capacity planning and workload management within your organization
  • Tracking and analyzing team member assignments and availability
  • Creating and managing work catalogs with effort scoring
  • Managing client assignments and project workloads
  • Generating internal reports and forecasts for business planning
  • Facilitating conversations about workload distribution and hiring needs

2.2 Not Intended For #

The Service is not intended to be used as:

  • A substitute for human resources software or HRIS systems
  • A performance review or employee evaluation system
  • A time tracking or surveillance tool
  • A legal compliance or regulatory reporting system
  • A replacement for professional HR, legal, or financial advice

3. User Responsibilities #

3.1 Accurate Information #

You agree to:

  • Provide accurate, truthful information when creating accounts and entering data
  • Keep your account information current and up-to-date
  • Not misrepresent your identity or affiliation

3.2 Appropriate Use of Employee Data #

When entering information about team members, you agree to:

  • Only input information you have the legal right to collect and process
  • Comply with all applicable employment, privacy, and data protection laws
  • Use the information solely for legitimate capacity planning purposes
  • Not use the Service to discriminate against employees or make employment decisions in violation of applicable laws
  • Inform affected individuals about your organization's use of the Service as required by applicable law

3.3 Appropriate Use of Client/Customer Data #

When entering information about clients or customers, you agree to:

  • Only input information you have the legal right to use
  • Comply with any confidentiality obligations you may have
  • Not input personally identifiable information about your clients' end users without proper authorization

3.4 Interpretation of Data #

You acknowledge and agree that:

  • The Service provides data and visualizations to assist your decision-making, not to make decisions for you
  • You are solely responsible for interpreting and acting upon information from the Service
  • Capacity data should be used to facilitate collaborative conversations, not as a punitive tool
  • All hiring, staffing, and compensation decisions remain your sole responsibility

4. Prohibited Activities #

4.1 Illegal Activities #

You may not use the Service for any purpose that is illegal or prohibited by applicable law, including but not limited to:

  • Violating any federal, state, local, or international law or regulation
  • Engaging in discriminatory employment practices
  • Violating employee privacy rights
  • Breaching confidentiality agreements
  • Money laundering or financing of terrorism
  • Any activity that could expose Capysaurus to civil or criminal liability

4.2 Harmful Use #

You may not use the Service in any way that:

  • Harms, threatens, harasses, or intimidates any person
  • Uses capacity data to retaliate against employees
  • Creates a hostile work environment
  • Infringes on the rights of others
  • Spreads false or misleading information

4.3 Security Violations #

You may not:

  • Attempt to gain unauthorized access to the Service, other accounts, or related systems
  • Probe, scan, or test the vulnerability of the Service without authorization
  • Interfere with or disrupt the Service or servers or networks connected to the Service
  • Circumvent any security measures or authentication systems
  • Introduce viruses, malware, or other harmful code
  • Attempt to decrypt, decompile, or reverse engineer any software used to provide the Service

4.4 System Abuse #

You may not:

  • Use automated means (bots, scrapers, crawlers) to access the Service without authorization
  • Overload, flood, or spam the Service
  • Engage in activities that consume excessive system resources
  • Interfere with other users' access to or use of the Service

4.5 Account Misuse #

You may not:

  • Share your account credentials with unauthorized parties
  • Create multiple accounts to circumvent limitations or restrictions
  • Allow others to use your account
  • Sell, resell, rent, or lease access to the Service
  • Use the Service on behalf of third parties without authorization

4.6 Competitive Use #

You may not:

  • Use the Service to develop a competing product or service
  • Benchmark the Service against competitive offerings without our written consent
  • Copy, reproduce, or imitate any features or functionality of the Service

4.7 Intellectual Property Violations #

You may not:

  • Remove, alter, or obscure any copyright, trademark, or proprietary notices
  • Use Capysaurus trademarks, logos, or branding without authorization
  • Claim ownership or authorship of the Service or any part thereof

5. Content Standards #

5.1 Your Content #

You are responsible for all content and data you input into the Service ("Your Content"). Your Content must not:

  • Contain false, misleading, or fraudulent information
  • Infringe on any third party's intellectual property rights
  • Violate any person's privacy rights
  • Contain defamatory, obscene, or offensive material
  • Violate any applicable law or regulation

5.2 Sensitive Information #

Exercise caution when inputting sensitive information into the Service:

  • Salary and compensation data: Ensure you have appropriate authorization and comply with any confidentiality requirements
  • Personal information: Minimize the personal information you input to what is necessary for capacity planning
  • Client information: Respect any confidentiality obligations you have to your clients

5.3 No Illegal Content #

You may not input, upload, or transmit any content that:

  • Promotes illegal activities
  • Contains threats of violence
  • Facilitates discrimination based on protected characteristics
  • Contains personal information about individuals without their consent (where consent is required by law)

6. Fair Use and Resource Limits #

6.1 Reasonable Use #

We expect all users to use the Service reasonably and in good faith. We reserve the right to limit or restrict usage that we determine, in our sole discretion, to be excessive or abusive.

6.2 Rate Limits #

We may implement rate limits or usage restrictions to ensure fair access for all users and protect the integrity of the Service. We will provide reasonable notice of any such limitations.

6.3 Storage Limits #

While we do not currently impose strict storage limits, we reserve the right to implement reasonable limits in the future with appropriate notice.

7. Enforcement #

7.1 Monitoring #

We do not actively monitor Your Content for compliance with this AUP, but we reserve the right to do so. We may investigate violations of this AUP that come to our attention.

7.2 Reporting Violations #

If you become aware of any violation of this AUP, please report it to support@capysaurus.com.

7.3 Consequences of Violations #

If we determine, in our sole discretion, that you have violated this AUP, we may take any action we deem appropriate, including:

  • Issuing a warning
  • Temporarily suspending your access to the Service
  • Permanently terminating your account
  • Removing or disabling access to any content that violates this AUP
  • Reporting violations to law enforcement authorities
  • Pursuing legal remedies

7.4 No Waiver #

Our failure to enforce any provision of this AUP does not constitute a waiver of that provision or any other provision.

8. Changes to This Policy #

We may update this Acceptable Use Policy from time to time. We will notify you of material changes by posting the updated policy on our website and updating the "Last Updated" date. Your continued use of the Service after any changes constitutes acceptance of the updated AUP.
